Side Quest — Terms of Use

About these terms

By using Side Quest you agree to these terms. They complement Apple’s standard Licensed Application End User License Agreement, which applies to apps downloaded from the App Store (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).

Using Side Quest

Side Quest suggests real-world experiences, called quests, that you can choose to live and remember. It is for your personal use.

Quests are ideas, not instructions or advice. You decide whether and how to do one, and you are responsible for your choices. Use your own judgment: consider your health, the weather, local rules and other people’s consent, and take care of your safety. Side Quest does not guarantee that any activity is safe or suitable for you, and it gives no medical or therapeutic advice.

Accounts

You can use Side Quest without an account. If you choose to sign in, it is done with Apple, and you are responsible for your Apple account. An account lets the app save your adventures, memories and photos and unlocks the server-side features of SideQuest+. You can delete your account at any time in the app (Account tab, “Delete my account”).

Your content

Your memories, notes, ratings and photos belong to you. You give By Else Studio only the permission needed to store and process them to provide the features of the app, including, when you ask for a chapter reading, sending the text described in the Privacy Policy to the provider that writes it.

Don’t add content you have no right to use, or that is unlawful or violates someone else’s privacy.

If you suggest an idea with “Suggest a Side Quest”, you confirm it is yours to share. We may read, edit, translate, publish or not publish it, as we choose. If it is published it becomes a public quest in the catalogue, without credit to you. Publication is never guaranteed.

SideQuest+

Side Quest is free to start. The free version includes a selection of quests and your first chapter of ten lived experiences. SideQuest+ is an optional subscription that continues your story: chapters beyond the first, the special “secret” quests, the written reading of completed chapters, and the PDF export of My story. What SideQuest+ includes may evolve.

SideQuest+ is an auto-renewable subscription, yearly or monthly. The price is shown by the App Store, in your currency, before you confirm. Payment is charged to your Apple ID at confirmation and the subscription renews automatically unless you cancel at least 24 hours before the end of the current period.

Billing is handled by Apple, not by By Else Studio. You can manage or cancel your subscription in your Apple Account settings, and request a refund from Apple under its policies. “Restore purchases” is available on the subscription screen. Deleting your Side Quest account does not cancel your subscription.

If you cancel, you keep SideQuest+ until the end of the period you have paid for. After that, or if the subscription is revoked, you return to the free version: the memories and chapters you have already created stay in the app, but you can no longer finish new experiences beyond the first chapter, open the special quests, request new chapter readings or export My story.

Acceptable use

Please don’t:

• interfere with or try to disrupt the app, its servers or their security;
• try to access another person’s data;
• use automated means to copy or extract the quest catalogue;
• suggest ideas that are unlawful, hateful or that contain someone’s personal information.

Intellectual property

Side Quest, its name, design, texts, the quest catalogue and its content belong to By Else Studio or its licensors. We grant you a limited, personal, non-transferable right to use the app. Your own content remains yours.

The service

Side Quest is provided as it evolves: we may add, change or remove quests and features, and the service may be unavailable from time to time. We do not promise that it will be uninterrupted or error-free.

Ending your use

You can stop using Side Quest or delete your account whenever you like. We may suspend access to the account-based features if these terms are seriously breached or to protect the service.

Disclaimer and limits

To the extent the law allows, Side Quest is provided “as is” and “as available”, and By Else Studio is not responsible for what happens during an activity you choose to do, nor for indirect losses. Nothing in these terms limits any right you have as a consumer that cannot be limited by law.

Changes to these terms

We may update these terms as the app evolves. The date at the top of the page shows the latest version. Continuing to use Side Quest after an update means you accept it.
